### Who Should Use Form 1095-B?

Form 1095-B should be used by every person or entity that provides minimum essential coverage to an individual during a calendar year. That includes insurers, small employers, and government programs like the ones listed above. If an employer has 50 or more employees, it is treated as an Applicable Large Employer (ALE) and must file Form 1095-C instead.

### When Is Form 1095-B Due?

Form 1095-B is due by February 28th if filing on paper or March 31st if submitting electronically. If these dates fall on a weekend or a federal holiday, they are moved to the next business day. Furthermore, insurers must furnish a copy of Form 1095-B to each covered individual by March 2nd every year.

### What Happens If Form 1095-B Is Not Submitted?

If Form 1095-B isn’t submitted, you may be facing two penalties: failure to file a correct information return and failure to provide a correct payee statement. Both of these penalties are $340 per return, with a maximum of $4,098,500. However, the penalty increases to $680 if intentional disregard is established.
